Until my representative arrives, I choose not to participate in this discussion.&#8221;<\/span><\/p>\n<p><span style=\"color: #999999;\">In 1975 the <a style=\"color: #999999;\" title=\"Supreme Court of the United States\" href=\"https:\/\/en.wikipedia.org\/wiki\/Supreme_Court_of_the_United_States\">United States Supreme Court<\/a> in the case of <i><a style=\"color: #999999;\" title=\"NLRB v. J. Weingarten, Inc.\" href=\"https:\/\/en.wikipedia.org\/wiki\/NLRB_v._J._Weingarten,_Inc.\">NLRB v. J. Weingarten, Inc.<\/a><\/i> <a style=\"color: #999999;\" title=\"List of United States Supreme Court cases, volume 420\" href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_United_States_Supreme_Court_cases,_volume_420\">420<\/a> <a style=\"color: #999999;\" title=\"United States Reports\" href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_Reports\">U.S.<\/a><a class=\"external text\" style=\"color: #999999;\" href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/420\/251\/\" rel=\"nofollow\">251<\/a> (1975) upheld a <a style=\"color: #999999;\" title=\"National Labor Relations Board\" href=\"https:\/\/en.wikipedia.org\/wiki\/National_Labor_Relations_Board\">National Labor Relations Board<\/a> (NLRB) decision that employees have a right to union representation at investigatory interviews. These rights have become known as the <b>Weingarten Rights<\/b>.<\/span><\/p>\n<p><span style=\"color: #999999;\">During an investigatory interview, the Supreme Court ruled that the following rules apply:<\/span><\/p>\n<p><span style=\"color: #999999;\"><b>Rule 1:<\/b> The employee must make a clear request for union representation before or during the interview. The employee cannot be punished for making this request.<\/span><\/p>\n<p><span style=\"color: #999999;\"><b>Rule 2:<\/b> After the employee makes the request, the employer must choose from among three options:<\/span><\/p>\n<ul>\n<li><span style=\"color: #999999;\">grant the request and delay questioning until the union representative arrives and (prior to the interview continuing) the representative has a chance to consult privately with the employee;<\/span><\/li>\n<li><span style=\"color: #999999;\">deny the request and end the interview immediately; or<\/span><\/li>\n<li><span style=\"color: #999999;\">give the employee a clear choice between having the interview without representation, or ending the interview.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #999999;\"><b>Rule 3:<\/b> If the employer denies the request for union representation, and continues to ask questions, it commits an <a style=\"color: #999999;\" title=\"Unfair labor practice\" href=\"https:\/\/en.wikipedia.org\/wiki\/Unfair_labor_practice\">unfair labor practice<\/a> and the employee has a right to refuse to answer.
